General Provisions

These Terms and Conditions ("Terms") apply to all purchases, sales contracts, and orders placed on Knut Bry Limited Edition (accessible via https://knutbry.com/).

By accessing our website and placing an order, you agree to be bound by these Terms.

Intermediary Sale

We act exclusively as an intermediary and sales agent.

All artworks sold through the online store are sold:

  • In the artist's name

  • On behalf of the artist

The artist is the contracting party and seller in the purchase.

We assist with:

  • Ordering and payment

  • Customer service

  • Coordination of delivery

  • Returns and handling of the right of withdrawal on behalf of the seller

Product Information & Orders

  • Offer and Acceptance: Displaying products on our online store constitutes an invitation to offer. By placing an order, you submit a binding offer to purchase the selected items. We reserve the right to accept or decline your order for legitimate reasons.

  • Contract Formation: A binding sales contract is formed only when we send you an Order Confirmation via email or dispatch the products to your designated address. The sales contract is formed between you and the artist (the seller); we facilitate the order on the seller's behalf.

  • Product Specifications: We make every effort to display product colors, features, and details accurately. However, actual colors and appearances may vary slightly depending on your device settings.

Pricing and Payments

  • Prices: Artworks are sold directly from the artist, with us acting as intermediary. All prices displayed on the website are listed in EUR (€). The sale of artworks may be exempt from ordinary Value Added Tax (VAT) under the rules applicable to sales by artists, unless stated otherwise. Shipping and handling charges are calculated and displayed at checkout.

  • Art Duty (Kunstavgift / BKH): For sales exceeding €200, a statutory art duty of up to 5% (Kunstavgift / BKH) is payable in addition to the purchase price, in accordance with the Norwegian Act on Duty on the Sale of Visual Art (kunstavgiftsloven). This duty is calculated and added at checkout.

  • Exercising Your Right: To exercise your right of withdrawal, you must notify us of your decision by a clear statement (e.g., an email sent to hello@knutbry.com).

  • Payment Methods: Payments can be made using Credit Card, Debit Card, Apple Pay, or Klarna, processed through secure payment solutions approved by Shopify. The amount is charged when you place your order.

  • Payment Security: Transactions are processed securely through certified third-party payment gateways. We do not store or process complete credit card details on our servers.

Shipping and Delivery

  • Delivery Regions: We ship to EU/EEA countries and specified international regions.

  • Delivery Times: Orders require 7–14 business days for production prior to dispatch. Estimated final delivery dates are provided at checkout and in your order confirmation email.

  • Transfer of Risk: Under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) § 14, the risk of loss or damage to goods passes to you once you (or a third party designated by you, other than the carrier) take physical possession of the items.

Returns & Cancellation

(In accordance with the Norwegian Right of Withdrawal Act (angrerettloven))

  • 14-Day Statutory Right: As a consumer residing within the EU/EEA, you have the statutory right to withdraw from this contract within 14 calendar days without providing any reason.

  • Withdrawal Period: The withdrawal period expires 14 days from the day you, or a third party indicated by you, receive physical possession of the goods.

  • Exercising Your Right: To exercise your right of withdrawal, you must notify us of your decision by a clear statement (e.g., an email sent to hello@knutbry.com).

  • Return Shipping Costs & Risk: Unless explicitly offered otherwise by us, you will bear the direct cost of returning the goods. Due to the high value of limited edition artworks, returns must be shipped via a tracked and fully insured courier service.

  • Exceptions to Right of Withdrawal: The right of withdrawal does NOT apply to:

    Artworks or certificates that have been manufactured to your specifications or given a clear personal touch at your explicit request (e.g., a custom dedication, a bespoke framing, or a size or format produced specifically for you and not otherwise offered as a standard edition). This exception does not apply to standard limited-edition prints ordered without such personalization.

    If you have handled the artwork beyond what is necessary to establish its nature, characteristics and function (for example, by damaging it or by not returning the original signed Certificate of Authenticity where this was supplied with the item), we may deduct an amount corresponding to the reduction in value from your refund. This does not affect your underlying right of withdrawal.

Statutory Guarantee and Conformity

  • Statutory Complaint Period: Under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) § 27, you must notify us of any defect within a reasonable time after you discovered or ought to have discovered it, and in any event no later than five years from delivery.

  • Remedies: If a product is defective or does not match its description, you are entitled to have it repaired or replaced free of charge. If repair or replacement is impossible or disproportionate, you may request an appropriate price reduction or a full refund.

Limitation of Liability

  • Nothing in these Terms limits or excludes our legal liability for death, personal injury caused by negligence, fraud, or any statutory liability that cannot be excluded under mandatory consumer laws.

  • Subject to applicable law, and without limiting your mandatory statutory rights to compensation under the Norwegian Consumer Purchases Act (forbrukerkjøpsloven) §§ 33–34, we shall not be liable for indirect, incidental, or consequential damages arising from the use of our services or products.

Customer Complaints and Dispute Resolution

  • Customer Support: If you experience any issues or have complaints regarding your purchase, please contact our support team first at hello@knutbry.com to reach an amicable solution.

  • Alternative Dispute Resolution (ADR): If a dispute cannot be resolved directly, you may bring the matter to the Norwegian Consumer Authority (Forbrukertilsynet) for mediation, and if unresolved, to the Consumer Disputes Board (Forbrukerklageutvalget). EU/EEA consumers may also submit complaints via the EU Online Dispute Resolution (ODR) platform or to accredited local Alternative Dispute Resolution (ADR) entities in their country of residence.

Governing Law and Jurisdiction

  • These Terms are governed by and construed in accordance with the laws of Norway, including its mandatory consumer protection legislation (such as the Consumer Purchases Act and the Right of Withdrawal Act). This is without prejudice to any mandatory consumer protection provisions applicable in your country of residence, which continue to apply if more favourable to you.

  • Any legal disputes shall be submitted to the competent courts of Norway or the courts of your EU/EEA place of residence.
